Pediatrician failed to save Infant’s Eyesight; paid $1.4M in Damages

A four month delay was all it took to cause permanent blindness in the infant victim from the NYC Medical Malpractice case which was recently awarded a $1.4M verdict.    The pediatrician took almost four months to correctly diagnose the brain tumor in this particular case.  Although, many doctors would agree with the attending physician that nothing would have been changed with an earlier diagnosis, this may not necessarily be true.  That is simply a prime example of common “argument/issue situations” in these types of malpractice cases.
One of the keys to addressing cases such as this is to find a medical expert to make a statement about your case.  In this one, the medical expert called was able to establish that even minor delays in diagnosis and treatment were a large factor in the potential for blindness.
This particular case did not end up in court.  Prior to the trial, the two sides agreed to a $1.4M settlement which was approved by the Brooklyn Supreme Court of the State of New York in an Infants Compromise Order.
